The Patient Protection and Affordable Care Act (PPACA) has been in force since October 1, 2013. The key-note of this reform is to ensure access to affordable and quality health care to all US-citizens, or to anyone who lives in the United States.

Important:

From 2016, this also applies retro-actively as of 01/01/2015 to foreigners who live in the USA and who are subject to income tax (Expats and their dependents).

Everyone who is subject to income tax in the US must take out insurance. Vacationers, by way of example, are exempt from this obligation. However, the case may be different for posted employees – so-called Expats – working abroad on behalf of their employer. Insofar as you are subject to taxation in the USA, you are also subject to the PPACA regulation and - in case of non-compliance – you may face penalty taxes.

As it stands, the insurance cover we provide for your organization complies with the requirements of Minimum Essential Coverage (MEC). We must confirm this MEC-compliance with the IRS.

The period for submissions to IRS for 2023 ends on 2/15/24 23:59 German time.
